The City of Lubbock's Deputy Director of Emergency Management has been indicted for possession of prepubescent child pornography, but his attorney says he is innocent.

38-year-old Justin David Musgraves was indicted on Wednesday, February 10th, and has since been placed on paid leave with the City while the investigation continues.

KAMC News reports the child pornography was found on a Surface tablet, which was dropped off with University Medical Center in September of 2020 for special software installation. This tablet was apparently assigned to Musgraves while he volunteered with the Shallowater Volunteer Fire Department, but it's unclear if he was the only person who had access to it.

Musgraves told a Texas DPS officer that he maintained a Microsoft OneDrive account that contained nude images, but no child pornography. Musgraves even provided written consent to search the tablet. The search is said to have revealed multiple images and videos of underage girls.

Musgrave's attorney, David Guinn, issued this statement:

Like every innocent person, Justin has tried to cooperate with the authorities to show them his innocence. We’re disappointed with the indictment. We look forward to seeing the evidence which we haven’t seen yet. It will be the strangest case of its type I have seen in 32 years.

 

We look forward to the [court] hearing on Wednesday and seeing why the [federal] government thinks he did this.

The initial appearance and arraignment for Musgraves has been scheduled for Wednesday, February 17th.
